Types of Trusts in California

Revocable Trust
One of the most popular forms of trusts created, the Revocable Trust can be changed or modified by the trustor so long as they are not deemed mentally incompetent. It does not require any permission from the beneficiary.

Irrevocable Trust
The Irrevocable Trust is another often created trust. The trustor may not modify this trust at any time after its creation, and the trustor gives up all rights to the trust.

Irrevocable Life Insurance Trust
The Irrevocable Life Insurance Trust allows the trustor to remove their life insurance policy from their estate, potentially exempting the trustee from taxes placed on the estate.

Testamentary Trust
Created as part of a Will, the Testamentary Trust will not go into effect until the trustor passes away.

Charitable Trusts
There are two types of Charitable Trusts in California.

  • A Charitable Lead Trust allows charities that the trustor chooses to receive interest from a financial gift for a set amount of time. When that period ends, whatever remains will go to the beneficiaries.
  • A Charitable Remainder Trust allows charities to receive interest on the amount of the trust until the trust term ends, at which point they will receive the trust amount.

Special Needs Trust
A Special Needs Trust is set up for a loved one with a disability. It allows the trustor to continue to provide financially for the trustee.
