Child Custody and Visitation Attorney in the Bay Area

For couples with children, there are many things to consider before a divorce can be finalized. The most important of these are child custody and visitation rights. In California, the law presumes that joint child custody is in the best interest of the child. A Bay Area child custody and visitation attorney from Anthoor Law Group recognizes that every family’s situation is unique and will take proactive measures to ensure that your children’s well-being is prioritized.

Custody is not just about being with your child physically. It can also include the right to make major decisions for your child’s education and medical needs, among others. Such decisions will greatly impact your child’s mental and emotional well-being, especially during their formative years. Our Bay Area child custody and visitation attorney will work with you so your divorce can be settled with fair custody terms in mind.

How Anthoor Law Group Can Help

Aside from working to secure your child’s best interests, the team at Anthoor Law Group has the experience and skills to handle the following:

How the Court Decides Custody and Visitation

Before a judge can decide on child custody, the divorcing couple can come up with their own terms and agreement, usually called a Parenting Plan. Our Bay Area child custody and visitation attorney can help review the terms to ensure your parental rights will be protected. Once the terms are mutually agreed upon, a judge will approve them.

If the parties cannot agree to a Parenting Plan, a judge can step in to decide. Following California law, the judge would presume that both parents are entitled to custody. However, the final decision will be based on additional factors that may be presented in court.

The judge will review any history of abuse and the current status of the child’s relationship with the parent. Our Bay Area child custody and visitation attorney will review the case according to the unique circumstances of your family to ensure that your children’s needs will be given weight by the judge.

Can Parties Change Custody Terms Later On?

As the needs of your children change, it may be time to review and update your Custody and Visitation Order. This could happen if you are moving for a new job or the children have to go to a new school. Parents are allowed to modify custody orders. Either party can initiate a Request for Modification, but a joint agreement may also be submitted to the court if the terms are already agreed upon.

The requesting party, however, has to prove that there is a good reason to modify the Order. It will boil down to whether the proposed Modifications are in the child’s best interest. Consult a child custody and visitation attorney from Anthoor Law Group to explore your options.

Know the Difference Between Legal and Physical Custody

Physical custody means your children physically live with you. Legal custody refers to a parent’s right to make major decisions for the child’s health, safety, and well-being. These include decisions on medical and educational matters.

It must be noted that sole physical custody does not necessarily include the sole legal custody of a child. There are instances where one parent may be granted legal custody but not physical custody, or vice versa. Talk to our Bay Area child custody and visitation attorney to learn more.

Factors Affecting Visitation Rights

If only one parent is granted sole physical custody, the other parent would still be entitled to visitation rights. The judge may order that alternating weekends and summer breaks will be part of the Visitation Schedule.

If the parent has a history of domestic or substance abuse, the judge might only allow supervised visitations. Our Bay Area custody and visitation attorney can further explain the nuances of a Visitation Order. Contact us today to schedule a consultation.
