Take The First Step of Estate Planning

Through a Will, you can control what happens to your properties once you pass. You can appoint an executor and choose your beneficiaries. Moreover, you can divide and distribute your properties in whatever way you see fit.

With a Will, you can also impose conditions before an heir or beneficiary would be allowed to receive their share. For example, you can allocate a certain sum of money to your youngest child — but only if they finish college. A condition like this can also be enclosed in a trust. It is important to address these concerns as part of a coordinated estate plan.

To create a valid Will, you must follow the requirements set by law. Our Bay Area Will attorney can help draft and review your Will to ensure it is legally valid and binding.

Secure Your Assets and Legacy

Aside from creating a Will, the team at Anthoor Law Group can also help you prepare the following estate planning tools:

  • Trusts
  • Guardianship
  • Healthcare Directives
  • Powers of Attorney
  • Trust Transfer Deeds
  • Quitclaim Deeds
  • Assignment of Business
  • Stock Power
  • HIPAA Authorization
  • Special Needs Trusts

Creating a Valid Will

In California, creating a valid Will is simple. To be a testator, you have to be at least 18 years old and of sound mind. Whatever prized possession you may have can be included in your Will – be it a cellphone, toy collection, or some other asset of value. After specifying who gets your assets, you have to sign the Will in front of two witnesses. Your witnesses are also required to sign your Will.

A Will does not have to be notarized to be valid. But if you want to make sure that your Will is complete in form, it is best to have our Bay Area Will attorney review it. In a Will, you must name an executor who will make sure your instructions are followed once you pass. If you have minor children, the lawyer will also encourage you to appoint a guardian for them.

Wills vs. Trusts

Aside from the Last Will, you can control the distribution of your estate through a Trust. Unlike a Last Will, a Trust does not have to go through probate. This saves your family the headache of going through a court proceeding.

If you are not sure how to start with estate planning, contact our team at Anthoor Law Group to learn about your options. Aside from Wills and Trusts, our attorneys are experienced in handling various estate planning tools such as Advance Health Care Directives, Powers of Attorney, HIPAA Authorization, Guardianships, Special Needs Trusts, Assignment of Business, Stock Power, Quitclaim Deeds, and more. What Is Probate?

A Last Will and Testament is validated by a judge during a court process called probate. In addition to executing Wills and handling estates, probate can handle guardianships, conservatorships, and related matters such as commitment of an individual. If there is no Will, then probate also determines who will receive the decedent’s assets, based on California law.

As it pertains to a Last Will and Testament, probate involves analysis of the authenticity and validity of the document. This step is necessary before the executor will carry out the directives written in the Will. It is a way of making sure that the Will is personally prepared by the person who passed away.

Probate can usually take months, but preparing a Will correctly can help to avoid confusion or delays that would contribute to its duration. Our Bay Area Will attorney can also assist in the process of probate.

Dying Without a Will: What Happens?

Dying without a Will (also known as intestate) means that your estate will be distributed according to the laws of succession in California. Your properties will pass to your legal heirs, who could either be your children, spouse, grandchildren, parents, or siblings. But unlike in a Will, you cannot control the shares they will get. Intestate succession will also be followed if a Will is found to be defective or invalid.

To avoid such missteps, schedule a consultation with a Will attorney at Anthoor Law Group today.
