Holographic Will. The most informal type of Will, a Holographic Will, is a legal document handwritten by an individual. It does not have to be witnessed. However, this will is only considered valid in California courts if the handwriting of the testator can be proven by witness testimony.

Statutory Will. A Statutory Will is typically what is known as a “fill-in-the-blanks” type of document. It is typically used by those who have a relatively small estate to leave and few other assets. The requirements for filling out the Will are stated in the document. This type of Will requires two witness signatures.

Attested Will. Attested wills are drawn up by an attorney and are considered self-proving, generally making their validity the least questioned of the three types of California Wills.

Crossing out or adding to an existing Will are not considered valid amendments. These may be accepted in very rare cases where the testator’s wishes are abundantly clear. However, this is generally not the case. In the case of minor changes, writing a codicil is the best option. It is a separate document from the existing will that adds, changes or revokes statements in the existing Will. A codicil must be created, signed, and added to the existing Will in the presence of two adult witnesses.
