What is guardianship?

Guardianship is when a court orders an adult, other than a child's parent to have custody of the child, or manage the child's property, or both. A probate guardianship of the person is necessary when a child is living with an adult who is not his or her parent, and the adult needs a court order to make decisions on behalf of the child.

A guardianship is established when one or both parents:

  • Are afflicted with a serious mental illness
  • Are in the Armed Services and are overseas
  • Have to enter rehab for a while
  • Are going to jail or prison
  • Have a drug or alcohol abuse problem
  • Have a history of domestic violence or
  • Are unable to take care of the child for some reason.

When contemplating ordering guardianship, the court shall consider the child's best interests to ensure that the child is raised in a stable, safe, and loving environment. A legal guardian can provide care for a child when the parents are unable to.

Two Types of Guardianship

There are two types of guardianships in California: guardianship of the person and guardianship of the estate. A guardianship of the person essentially steps in and has the same responsibilities as a biological parent. This means that the guardian has full legal and physical custody of the child.

A guardianship of the estate is established to manage a child's money or income until the child reaches the age of 18. Some children need a guardian of the estate when they inherit money or assets. Typically, the court appoints the surviving parent to act as the guardian of the estate.
